The Regulatory Reform (Fire Safety) Order 2005, or RR(FS)O, as it’s commonly known, applies to all non-domestic premises in England and Wales. This includes the communal areas of blocks of flats and houses of multiple occupation (HMOs). It applies to virtually all premises, and covers nearly every type of building, structure and open space.
The RR(FS)O defines the “Responsible Person”. This is the person who owns the premises or business or the person with control over the premises, business or activity. The Responsible Person must carry out a Fire Risk Assessment, produce a policy, develop procedures (particularly with regard to evacuation), provide staff training and carry out fire drills.
The Responsible Person must implement appropriate fire safety measures to minimise the risk to life from fire, i.e. they must provide and maintain clear means of escape, signs, notices, emergency lighting, fire detection and alarm, and means of firefighting (extinguishers).

The RR(FS)O states the Responsible Person must appoint Competent Persons to carry out various tasks associated with fire safety. It’s the Responsible Person’s duty to ensure anyone appointed to install or maintain fire safety products and systems is competent. Third party accreditation, i.e. LPS1014 or BAFE SP203 Approval proves this competence.

“Fire protection products and related services should be fit for their purpose and properly installed and maintained in accordance with the manufacturer’s instructions or the relevant British Standard.
Third party certification schemes for fire protection products and related services are an effective means of providing the fullest possible assurances, offering a level of quality, reliability and safety that non-certificated products may lack. This does not mean goods and services that are not third party approved are less reliable, but there is no obvious way in which this can be demonstrated.
Third party quality assurance can offer great comfort to employers, both as a means of satisfying you that the goods and services you have purchased are fit for purpose, and as a means of demonstrating that you have complied with the law.”
